What constitutes a nuisance from Noise, Dust, Smoke or Odour.
A nuisance is considered if noise, dust, smoke or odour has unreasonably interfered with or is likely to interfere unreasonably with the enjoyment of the area by persons occupying a place or lawfully resorting to the area.

Excessive or unconstrained rubbish, waste or vegetation or stockpiled, excessive or unconstrained disused or derelict items or material that a reasonable person would consider to be rubbish or waste that unreasonably interferes or is likely to interfere unreasonably with the enjoyment of the premises occupied by the person in the vicinity.

What is illegal dumping?
Illegal dumping is a result of people unlawfully dumping unwanted items such as mattresses, household furniture, electrical goods, building material and tyres in front of houses, alongside roads, on reserves and in creeks without the approval of Council. Illegally dumped rubbish can result in a  substantial fine and possible prosecution action as it poses a risk to the health and safety of the community, as well as potentially harming the environment by contaminating land and waterways.
Risks involved with illegal dumping include;

  • sharp objects which could cause injury
  • asbestos which poses a threat to public health
  • toxic substances which could injure or kill
  • nappies and medical waste as a biological threat
  • possible fire hazards
  • potential to block storm water drains
